Privacy Policy
Effective Date: August 11, 2026
Last Updated: August 11, 2026
1. Introduction and Scope
This Privacy Policy describes how DMTA Studios, LLC ("DMTA Studios," "we," "us," or "our"), located in Bowling Green, Kentucky, USA, collects, uses, and protects your personal information. This policy applies to your use of the HarmoniSensei™ application across all platforms (Android, macOS, Windows, Web) and our associated backend services (collectively, the "Service").
2. Our Zero-Knowledge Architecture (What We Cannot See)
Privacy is built into the core of HarmoniSensei™. We utilize post-quantum end-to-end encryption (E2EE) and hardware-backed local encryption to protect your communications.
- Zero-Knowledge Messaging: Direct messages, group text channels, and their attached media are end-to-end encrypted. We act strictly as a zero-knowledge relay. We cannot read your messages, decrypt your private media, or listen to your voice and video calls.
- Call Routing: Voice and video calls are established peer-to-peer. We only relay encrypted media through our servers if a direct connection cannot be established.
- Local Biometrics: HarmoniSensei™ uses your device’s biometric authentication (fingerprint or facial recognition) to unlock your encrypted local chat storage. We never collect, store, or transmit your biometric data. This process happens entirely on your local device's secure hardware.
3. Information We Collect
While we cannot access your E2EE communications, we do collect specific data necessary to operate the platform, route messages, and manage accounts.
- Account & Identity Data: Your email address, phone number, display name, username (handle), and password (which is strictly stored using Argon2id cryptographic hashing; we never hold passwords in plaintext).
- Profile Data: Optional information you choose to provide, such as an avatar, banner image, bio, birthday, gender, pronouns, and website URLs.
- User-Generated Content (Public): Posts, articles, books, podcasts, videos, and music you publish to public or subscriber-only tiers, alongside your community interactions (comments, reactions).
- Commerce Data: Purchase and subscription records. Payment processing is handled entirely by our payment provider (Stripe). We do not collect or store your credit card or bank account numbers.
- Device & Technical Data: App version, operating system, push notification tokens, and per-account device identifiers required strictly for routing your encrypted messages to the correct device.
- AI Generation Data: Prompts you submit to the "AI Canvas" feature and the resulting generated text, image, audio, or video outputs.
4. What We Do NOT Do
To provide further clarity on our privacy commitments:
- We do not sell your personal data.
- We do not use third-party advertising networks.
- We do not embed third-party tracking SDKs to monitor your behavior across other apps or websites.
5. How We Use Your Information
We process your data strictly to:
- Create and secure your account (including Two-Factor Authentication).
- Route E2EE messages and establish WebRTC call signaling.
- Distribute public and subscriber-only media via IPFS.
- Facilitate creator monetization, virtual gifts, and subscriptions.
- Generate content via the AI Canvas upon your direct request.
- Comply with legal obligations and enforce our Terms of Service.
6. Sub-Processors and Third-Party Sharing
We share specific data with trusted third-party providers solely to deliver platform features. We ensure these providers are bound by strict data processing agreements.
| Provider | Purpose | Data Shared |
|---|---|---|
| Stripe | Payments & Creator Subscriptions | Purchase metadata; identity data for Connect onboarding |
| Pinata (IPFS) | Decentralized Media Storage | Uploaded media (encrypted at rest via AES-256-GCM) |
| Cloudflare | TURN Relay for Calls | Real-time encrypted media (only when direct peer-to-peer fails) |
| Google Cloud / Firebase | Hosting & Notifications | Server-side routing data, device push tokens |
| Google, MiniMax, ByteDance, Vidu, Alibaba | AI Canvas Generation | User prompts and generated media outputs |
| GitHub | App Updates | None (used strictly for downloading signed app updates) |
7. International Data Transfers & AI Canvas
Because DMTA Studios is based in the United States, your data is processed in the US. However, to provide our AI Canvas features, we partner with AI model providers located globally, including the People's Republic of China (e.g., MiniMax, ByteDance, Vidu, Alibaba). When you use the AI Canvas, you acknowledge that your prompt data will be transmitted to these international sub-processors. For users in the European Economic Area (EEA) and the UK, we safeguard these transfers utilizing Standard Contractual Clauses (SCCs) approved by the European Commission, ensuring your prompts are used exclusively to fulfill your request and not to independently train third-party foundation models.
8. Data Retention, Blockchain Immutability, and Deletion
You may delete your account at any time through the app settings. Upon deletion, we remove your account credentials, profile data, and plaintext routing logs from our central database. Exceptions to Deletion:
- E2EE Content: Because we do not hold the decryption keys, we cannot recover or delete encrypted chat history stored locally on your device or on the devices of your recipients.
- Blockchain Data: HarmoniSensei™ integrates with SempreChain™. Any transactions, token delegations, or DAO proposals you voluntarily commit to the public blockchain are immutable and cannot be deleted or altered by DMTA Studios.
- Financial Records: We retain transactional data related to creator monetization as required by US tax and accounting laws.
9. Your Privacy Rights (KCDPA & GDPR)
Depending on your jurisdiction—including residents of Kentucky (under the KCDPA) and the European Union (under the GDPR)—you maintain specific rights regarding your data:
- Right to Access & Portability: Request a copy of the personal data we hold about you. (Note: We cannot export the plaintext content of E2EE messages).
- Right to Deletion: Request the erasure of your personal data, subject to the blockchain and financial exceptions noted above.
- Right to Correction: Update or correct inaccurate profile data.
- Right to Opt-Out of Sensitive Data Processing: We require your explicit opt-in consent to process sensitive data, such as sharing your precise location in a chat (which operates peer-to-peer).
- Right to Appeal: If we decline a data request, you have the right to appeal our decision.
To exercise these rights, please contact us at [email protected] or via the privacy settings within the HarmoniSensei™ app.
10. Age Requirements and Children's Privacy
HarmoniSensei™ is not directed at children. You must be at least 18 years old to create an account. We do not knowingly collect personal data from children under 18. Furthermore, users must be at least 18 years old to utilize Creator Monetization features, purchase virtual gifts, or participate in the SempreChain™ DAO. If we discover we have collected data from a user under 18 without verifiable parental consent, we will delete the account immediately.

Terms of Service
Effective Date: August 11, 2026
Welcome to HarmoniSensei™! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and DMTA Studios, LLC ("DMTA Studios," "we," "us," or "our"), located in Bowling Green, Kentucky, USA. By downloading, accessing, or using the HarmoniSensei™ application, website, and backend services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Account Registration
- Minimum Age: You must be at least 18 years old to create an account.
- Monetization and Governance: You must be at least 18 years old to utilize Creator Monetization features, purchase digital goods or subscriptions, or participate in the SempreChain™ DAO.
- Account Security: You are responsible for safeguarding your account credentials (including passwords and Two-Factor Authentication codes).
2. End-to-End Encryption (E2EE) and Data Loss Warning
HarmoniSensei™ is designed with a zero-knowledge privacy architecture. Direct messages, group text channels, and their attachments are end-to-end encrypted.
- No Access: DMTA Studios acts strictly as a ciphertext relay. We cannot read, decrypt, or monitor your E2EE communications.
- Local Storage: Your chat history is encrypted and stored locally on your device, unlocked by your device's biometric or PIN security.
- Loss of Access Warning: Because we do not hold your encryption keys, DMTA Studios cannot recover your chat history if you lose your device, delete the app, or forget your password. You expressly accept the risk of permanent data loss if your local device keys are lost or destroyed.
3. The SempreChain™ Non-Custodial Wallet
Upon account creation, the Service automatically generates an embedded, non-custodial wallet on the SempreChain™ blockchain.
- Non-Custodial Nature: You alone control the private keys (Secret Recovery Phrase) to your wallet. DMTA Studios does not custody your keys, cannot initiate transactions on your behalf, and cannot recover your wallet if you lose your recovery phrase.
- Not a Financial Instrument: The SempreChain™ Wallet is strictly an identity, cryptographic-signing, and decentralized-governance tool. Holding a wallet or participating in the DAO confers no equity, dividends, ownership rights, or expectation of profit in DMTA Studios, LLC.
- Blockchain Immutability: Any data, transactions, or votes committed to the SempreChain™ blockchain are permanent. DMTA Studios cannot alter, reverse, or delete blockchain-based transactions.
4. Fiat-Only Monetization (Stripe Integration)
To ensure regulatory compliance, all in-app purchases, creator subscriptions, and virtual gifts are denominated and settled strictly in fiat currency (e.g., USD). HarmoniSensei™ does not process cryptocurrency payments or digital asset swaps.
- Third-Party Processor: All payments and payouts are processed by our third-party partner, Stripe. By monetizing content or making purchases, you agree to the applicable Stripe Services Agreement and Stripe Connected Account Agreement.
- Creator Liability: Creators act as independent entities. If you are a monetizing creator, you are solely responsible for paying applicable taxes on your earnings and are directly liable for any user refunds or credit card chargebacks assessed against your account.
5. User-Generated Content & Section 230 Safe Harbor
HarmoniSensei™ allows users to publish public media (Articles, Books, Audio, Video) and generate media via the AI Canvas.
- Not a Publisher: Under Section 230 of the US Communications Decency Act (47 U.S.C. § 230), DMTA Studios is a provider of an interactive computer service. We are not the publisher or speaker of any information provided by our users and assume no liability for user-generated content.
- Content Moderation: We reserve the right (but have no obligation) to remove, restrict, or demote public content that violates our Acceptable Use Policy, including illegal material, non-consensual intimate imagery, or harassment.
- IPFS Decentralized Storage: Public media is pinned to the InterPlanetary File System (IPFS). While we can block content from appearing within the HarmoniSensei™ app interface, we do not control the underlying decentralized IPFS network.
6. Copyright Policy (DMCA)
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). We will promptly remove or disable access to infringing public content upon receipt of a valid takedown notice and will terminate the accounts of repeat infringers.
7. Disclaimers of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, DMTA Studios expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or completely secure.
8. Limitation of Liability
To the fullest extent permitted by law, in no event shall DMTA Studios, LLC, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill (including, but not limited to, the loss of E2EE keys or blockchain assets), resulting from your access to or use of (or inability to access or use) the service.
9. Dispute Resolution, Arbitration, and Class Action Waiver
- Governing Law: These Terms and any dispute arising from them shall be governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
- Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA), rather than in court. The arbitration shall take place in Bowling Green, Kentucky.
- Class Action Waiver: You and DMTA Studios agree that any claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via the app or email prior to the changes taking effect. Your continued use of the Service constitutes acceptance of the modified Terms.
Acceptable Use Policy & Community Guidelines
Effective Date: August 11, 2026
HarmoniSensei™ is built to empower creators, protect privacy, and foster decentralized communities. Because we offer End-to-End Encrypted (E2EE) private messaging alongside public-facing social feeds and live streaming, it is vital to distinguish between what you do privately and what you publish to the world. While we do not monitor your E2EE private chats, any content published to public feeds, subscriber-only tiers, live streams, or generated via the AI Canvas must adhere to this Acceptable Use Policy (AUP). Violating these guidelines may result in content removal, demonetization, or permanent account termination.
1. Public Content & Publications
When you publish Books, Articles, Journals, Podcasts, Video, Music, or general social posts to the Discover feed or your public profile, you must respect the following rules:
- Child Sexual Abuse Material (CSAM): Zero tolerance. We will immediately terminate your account, preserve relevant metadata, and report you to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement.
- Non-Consensual Intimate Imagery (NCII): You may not post or threaten to post intimate images or videos of someone without their explicit consent (commonly referred to as "revenge porn").
- Hate Speech and Harassment: You may not attack, threaten, or incite violence against individuals or groups based on race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, or serious disease/disability.
- Doxxing and Privacy Violations: You may not publish someone else's personal information (e.g., home address, private phone numbers, financial information) without their consent.
- Intellectual Property Infringement: You may not publish or monetize copyrighted media, trademarks, or proprietary content that you do not own or have a license to use. (See our DMCA Policy for takedown procedures).
- Illegal Goods and Services: You may not use public feeds to sell, facilitate, or promote the sale of illicit drugs, un-serialized firearms, or stolen goods.
2. Live Streaming Guidelines
Live streaming to your community or subscribers carries real-time risks. In addition to the Public Content rules above, live broadcasters must abide by the following:
- No Broadcasting of Illegal Acts: You may not stream yourself or others committing crimes, including vandalism, theft, or physical assault.
- Self-Harm and Graphic Violence: You may not broadcast acts of self-injury, suicide, or gratuitous, real-world violence.
- Dangerous Challenges: You may not encourage or participate in viral challenges that pose a severe risk of physical injury or death.
- Unauthorized Broadcasting: You may not live stream movies, television broadcasts, pay-per-view sporting events, or live concerts where you do not hold the broadcasting rights.
3. AI Canvas & Generative Media Rules
The HarmoniSensei™ AI Canvas utilizes third-party AI models to generate text, images, audio, and video from your prompts. Because generative AI presents unique ethical and legal challenges, strict rules apply:
- Prohibited AI Generations: You may not use the AI Canvas to generate:
- CSAM or any sexualized depictions of minors.
- Non-consensual intimate imagery (NCII) or deepfake pornography.
- Content designed to facilitate fraud, phishing, or social engineering attacks.
- Automated harassment or bulk spam messaging.
- Deepfakes and Misinformation: You may not generate synthetic audio, video, or images of real, identifiable people (including politicians, celebrities, or private citizens) engaging in acts they did not actually do, with the intent to deceive the public.
- Mandatory AI Transparency Labels (EU AI Act Compliance): To comply with global transparency standards, including Article 50 of the EU AI Act (effective August 2026), you must not intentionally remove or obscure the AI-generation watermarks or metadata automatically applied to content exported from the AI Canvas. If you publish highly realistic, AI-generated synthetic video or audio (deepfakes) concerning matters of public interest on HarmoniSensei™, you are strictly required to label the content as artificially generated within the post description.
- Prompt Injection and Jailbreaking: You may not attempt to systematically bypass, exploit, or "jailbreak" the safety filters of our AI sub-processors.
4. Enforcement and Appeals
- Moderation: DMTA Studios relies on a combination of automated hashing (e.g., PhotoDNA for CSAM), user reporting, and human review to moderate public-facing content.
- Consequences: Depending on the severity of the violation, we may issue a warning, remove the violating content, disable your Stripe monetization features, or permanently terminate your account.
- Appeals: If you believe your content was removed in error, you may submit an appeal through the HarmoniSensei™ in-app Support Center. Our moderation team will review the decision.
